MINNEAPOLIS (KFGO) – No decision yet from Judge Peter Cahill on the defense’s request for a new trial for ex-Minneapolis officer Derek Chauvin.
Attorney Eric Nelson cited judicial and prosecutorial misconduct as two of the reasons for a re-trial.
Former U-S Attorney for Minnesota Tom Heffelfinger says it’s not common for a judge to “overrule” himself and grant such a motion, but he adds that this is a unique case.
The state is seeking a stiffer sentence for Chauvin due to what prosecutors called Chauvin’s “cruel punishment” of George Floyd and because a child was present at the time.
Cahill also has to rule on a defense motion objecting to the request for an upward departure from sentencing guidelines.
