BISMARCK, ND (KFGO) – The North Dakota Supreme Court has dismissed a lawsuit filed against Richland County and a deputy sheriff over the death of a State College of Science Student.
The parents of Andrew Sadek sued for negligence, fraud and deceit. The 20-year-old Sadek was working as a drug informant when his body was found in June 2014 in the Red River north of Breckenridge, Minnesota. His parents argued that the death was related to his work as an informant.
A district court judge had earlier dismissed the suit. The body had a gunshot wound to the head and was weighted down with rocks in a backpack. His parents believe he was murdered.
Sadek’s mother, Tammy, said she’s extremely disappointed with the high court’s decision. She said attorneys representing her and her husband will decide whether to ask the court to reconsider.
In the 4-1 opinion, Justice Gerald VandeWalle dissented. He wrote that “viewing the evidence in the most favorable to the Sadeks, I believe summary judgement was inappropriate because genuine issues of material fact exist.”
