FARGO (KFGO) – A district judge has ruled that a woman who sued the West Fargo VFW and a man she accused of rape must collect any judgement from the club’s insurance provider.
The woman was drinking with Bruce McCartney in Aug. of 2019. The woman said she didn’t know McCartney, who lived in an apartment above the club. Because of her intoxicated state, employees helped McCartney get the woman to his apartment. McCartney later pleaded guilty to sexual assault and spent just over two years in prison.
Fargo attorney Craig Johnson, who represents the VFW, says the club has always denied liability and continues to do so. He says the ruling from East Central District Judge Wade Webb allows the woman to attempt to collect $150,000 from the club’s insurance company.
The civil lawsuit was scheduled for a pre-trial hearing next week. The hearing has been canceled.
